1. Acceptable Uses
By using our service, you agree to comply with our policies. You must be at least 18 years of age to purchase our hosting or design services. You are expected to use the Internet with respect, courtesy and responsibility, giving due regard to the rights of other Internet users. We expect you to have a basic knowledge of how the Internet functions, the types of uses which are generally acceptable, and the type of uses which are to be avoided.
Common sense is the best guide as to what is considered acceptable use. The following are unacceptable uses:
Illegality, in any form, including but not limited to activities such as unauthorized distribution or copying of copyrighted software, violation of U.S. export restrictions, harassment, fraud, trafficking in obscene material, drug dealing, and other illegal activities.
Net Abuse including but not limited to activities such as using a non-existent return email address on commercial solicitation, spamming (sending unsolicited advertising to numerous email addresses or newsgroups and/or generating a significantly higher volume of outgoing email than a normal user), trolling (posting outrageous messages to generate numerous responses), mail-bombing (sending multiple messages without significant new content to the same user), subscribing someone else to a mailing list without that person's permission, cross-posting articles to an excessive number of newsgroups, or attempting without authorization to enter into a secured computers system (hacking). Computer virus origination or population. We reserve the right to determine what constitutes net abuse.
Tortious conduct including but not limited to posting of defamatory, libelous, or private information about a person without their consent, intentionally inflicting emotional distress, or violating trademarks, copyrights, or other intellectual property rights.
Misuse of system resources including but not limited to employing posts or programs which consume excessive CPU time or storage space; permitting use of mail services, mail forwarding capabilities, POP accounts, or auto-responders other than for the customer's own account; or resale of access to CGI scripts installed on our servers.
NO ADULT SITES - The Internet is part of a large global community and our visitors and customers come from all over the world. Because of differing ideologies and opinions based on culture, it is difficult to determine what is considered "adult material." While it is not our function to judge and say what is or is not "adult" in nature, we at LitterBox Designs developed a "NO ADULT SITES" policy. Reason:
Because our servers contain multiple domain names per server, our bandwidth resources for each server are a "shared-resource" (our total bandwidth is divided up between all of our hosted sites). An average "adult site" gets more hits than 100 standard websites. Some smaller "adult sites" can receive in excess of 5 GB of transfer per day. If this were to happen, our server could be severely slowed and this would affect all of our clients. In addition, this large amount of bandwidth usage would cause a raise in prices to be necessary. We work hard to keep our servers fast and our bandwidth usage low.
While it is not the business of LitterBox Designs to judge whether or not the "adult business" is good or bad, we feel (and research has shown) that most businesses prefer to operate on a server that is "porn-free."
LitterBox Designs defines "adult material" within the following statement:
While it is hard to be definitive as to what is acceptable and what is in clear violation of our policy, we've found the following rules to be the most effective in defining "adult material."
Any site whose revenue is generated in part or in whole from its "adult content", this includes banners, pop-ups and redirects.
Photographs or videos showing frontal nudity (male or female) for any other reason than scientific, medical or artistic purposes.
Revenue-generating hyperlinks to sites who violate the first item.
LitterBox Designs reserves the right to decide what it considers as "adult content," "adult material," "sexually explicit," or "sexually related." Feel free to contact us at service@LitterBoxDesigns.com if you are unsure if your site violates these terms. LitterBox Designs reserves the right to terminate the service of any client violating this Agreement/Policy.
UCE (SPAM) Policy - "SPAM" is the common term for "UCE" (Unsolicited Commercial E-mail). Spam has become an ever-growing problem on the Internet. Many ISPs, upstream providers, and service providers have assumed a very strict position on SPAM.
BULK UCE, promotional material, or other forms of solicitation sent via email that advertise any IP address belonging to LitterBox Designs or any URL (domain) that is hosted by LitterBox Designs.
Unsolicited postings to newsgroups advertising any IP or URL hosted by LitterBox Designs.com.
The use of web pages setup on ISPs that allow spamming (also known as "ghost sites"), that directly or indirectly reference customers to domains or IP addresses hosted by LitterBox Designs in mass
e-mailings are also prohibited.
What does the law say about UCE? - US Code Title 47, Sec.227(a)(2)(B), a computer/modem/printer meets the definition of a telephone fax machine. By Sec.227(b)(1)(C), it is unlawful to send any unsolicited advertisement to such equipment. By Sec.227(b)(3)(C), a violation of the aforementioned Section is punishable by action to recover actual monetary loss, or $500.00, whichever is greater, for each violation."
LitterBox Designs reserves the right to determine what is and what is not "SPAM", "UCE," "Mail Bombing," "Bulk-email," or Virus origination/population. Feel Free to contact LitterBox Designs if you are unsure of any of these items. LitterBox Designs reserves the right to terminate the service of any client violating this policy.
